Terms of Use & End User License Agreement (EULA)

By downloading, installing, or using any of our applications or games (“App” or “Game”), you agree to be bound by these Terms of Use and End User License Agreement (“Agreement”). If you do not agree, do not install or use the App.
1. Definitions
“We”, “Us”, “Our” means Zain UI Abideen.
“You” means the person who downloads, installs, or uses the App, or the company you represent.
“App Store” means the Apple App Store or any other store from which you download the App.
“Device” means any mobile, tablet, or other device on which you install and use the App.
“In-App Purchases” means any paid digital content, items, or subscriptions available inside the App.
2. License to Use the App
2.1. We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for personal and non-commercial use, in accordance with this Agreement and the App Store rules.
2.2. You agree that you will not:
Copy, modify, or create derivative works of the App.
Sell, rent, lease, distribute, or transfer the App to any third party.
Reverse engineer, decompile, or attempt to extract the source code of the App, except where allowed by law.
Remove or alter any copyright, trademark, or other proprietary notices in the App.
The App is licensed, not sold to you.
3. Relationship with App Store
This Agreement is between you and us, not with the App Store. The App Store is not responsible for the App or its content. However, the App Store and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
4. Intellectual Property
All rights, title, and interest in and to the App (including graphics, text, code, designs, and all other content) are owned by or licensed to Zain UI Abideen. You do not gain any ownership rights in the App; you only receive the limited license described above.
5. Changes, Updates, and Availability
We may modify, update, or discontinue the App (or any part of it) at any time, with or without notice. Updates may add, change, or remove features. By continuing to use the App after an update, you agree to the updated version.
We are not obligated to provide any specific feature, update, or support, unless required by law.
6. Third-Party Services
The App may show third-party content or links (for example, ads, websites, or services). We are not responsible for:
The accuracy, safety, or legality of third-party content or services; or
Any loss or damage caused by third-party services.
Your use of third-party services is at your own risk and subject to their own terms and privacy policies.
7. Privacy
We process your personal data in accordance with our Privacy Policy.
Please read our Privacy Policy to understand what data we collect, how we use it, and your rights.
Avoid sharing personal or sensitive information inside the App where it can be seen by others. Any information you share is at your own risk.
8. In-App Purchases & Subscriptions
Some Apps may offer in-app purchases, including one-time purchases and auto-renewable subscriptions.
8.1. Processing of Payments
All payments are handled by the App Store using your App Store account. We do not receive or store your credit card or payment method details. Purchases are subject to the App Store’s own terms and conditions.
8.2. Types of Purchases
Consumable items: Used up during gameplay (e.g., coins, lives, energy, boosts). Once used, they cannot be restored or transferred.
Non-consumable items: Permanent unlocks within that App (e.g., Remove Ads, extra levels).
Non-renewing subscriptions: Time-limited access that ends automatically. You must purchase again for continued access.
Auto-renewable subscriptions: Automatically renew at the end of each period (for example, weekly, monthly, or yearly) until you cancel.
The name, price, duration, and benefits of each purchase are shown on the purchase screen before you confirm.
8.3. Auto-Renewal
Your App Store account is charged when you confirm a subscription.
It will automatically renew unless you cancel in your App Store account settings at least 24 hours before the end of the current period (or as required by the App Store).
Renewal is charged at the price shown in the App Store at the time of renewal, subject to the App Store’s policies. The App Store may notify you of price changes and may ask you to confirm before charging the new price.
8.4. Free Trials
If a subscription includes a free trial, the duration and conditions are shown on the purchase screen. If you do not cancel at least 24 hours before the end of the trial (or as required by the App Store), it will convert into a paid subscription and your account will be charged.
8.5. Managing Subscriptions
You can view, manage, or cancel your subscriptions at any time in your App Store account settings. Deleting the App does not cancel your subscription. You must cancel through your App Store account to stop future charges.
8.6. Refunds
All purchases are processed by the App Store. Any refund requests must be made through the App Store (for example, via its “Report a Problem” page) and are subject to the App Store’s own refund policy. We normally cannot provide refunds directly. Your statutory consumer rights, if any, are not affected.
8.7. Virtual Items
Any virtual currency, items, or benefits you obtain are digital content only, have no real-world monetary value, and:
Cannot be exchanged for real money or real goods;
Are only licensed for use in the relevant App;
Are generally non-transferable between users or between Apps (unless we clearly say otherwise); and
May be changed, limited, or removed by us at any time, as allowed by law.
9. Children, Parents, and Guardians
If you allow a minor to use the App on your device:
You are fully responsible for the minor’s use of the App; and
You are responsible for any in-app purchases made using your App Store account.
Use the parental controls and purchase restrictions offered by the App Store to help manage and control spending.
10. Termination
We may suspend or terminate your access to the App at any time if you violate this Agreement or misuse the App. You may stop using the App at any time by deleting it from your devices.
Upon termination, the license granted to you ends, and you must stop using and delete the App.
11. Disclaimer & Limitation of Liability
The App is provided “as is” and “as available” without any warranties of any kind, to the maximum extent permitted by law. Use of the App is at your own risk.
To the maximum extent permitted by law:
We are not liable for any indirect, incidental, or consequential damages; and
Our total liability for any claim relating to the App will not exceed the amount you have paid for the App or in-app purchases in that App (if any).
Some countries do not allow certain exclusions or limitations; in that case, these may not apply to you to the extent prohibited by law.
12. Governing Law
Unless otherwise required by local law, this Agreement is governed by the laws of Pakistan, without regard to its conflict-of-law rules. You may also have protections under mandatory laws of your country of residence.
